CONSULTATION

An appointment will be made for the parties  to come in for a brief consultation.  During this meeting, we will determine if the case is appropriate for mediation and therefore we require that all parties involved attend this meeting.  The meeting will give your mediator the opportunity to understand the types of issues involved in your particular situation, how we propose to help you and the procedures that we will employ for that purpose so that a more accurate estimate of how long the process will take and how much it will cost can be determined.  Questions about mediation will be answered.  If you choose, you may begin the first session of mediation immediately following the consultation.

SESSIONS

Sessions are usually 1 hour. The parties and the mediator generally meet on a weekly or bi-weekly basis, and this can be modified as needed. If appropriate the mediator can suggest calling in other professionals to assist in resolving the conflict and make informed decisions. MEMORANDUM OF UNDERSTANDING / MEMORANDUM AGREEMENT

In mediation understandings  and agreements are reached on all issues necessary to resolve the issues between the parties.  All laws, acts, and guidelines are followed. The mediator prepares a plain language memorandum of understanding or memorandum of agreement setting forth all the terms needed to draft a legally binding agreement between the parties with the exception of legal language and signatures.

RESULTS

The parties may then submit the memo to their attorney(s) or a neutral attorney that works with Just Mediation Inc who prepare a formal, legally-binding agreement.  Mediation is not intended to resolve past conflicts Rather, the process seeks to explore options so that all parties may put the past behind them and concentrate on the future.
