Same sex marriage in the state of New York became legal on July 24, 2011, under the Marriage Equality Act, which was passed by the New York State Legislature on June 24, 2011 and signed by Governor Andrew Cuomo on the same day.

IRS NOW RECOGNIZES ALL GAY MARRIAGES, REGARDLESS OF STATE THE COUPLE RESIDES

As of August 29, 2013,  The U.S Treasury Department issued a Federal rule change that recognizes legally married same sex couples for Federal Tax purposes, whether or not  gay marriage is legal in the state in which the couple lives.  In the 2013 tax year, same sex couples who are legally married MUST file together as married filing jointly or individually as married filing separately.

THIS IS GOOD NEWS! 

• The address or location of the wedding does not matter, as long as the marriage was legal
• This assures the couple that they can move "freely" around the country and not lose their filing status
• Same sex couples may also be able to file amended returns to determine refund eligibility 
• Gay and Lesbian couples will now enjoy the essential tax benefits and protections that were previously denied to them under the discriminatory Defense of Marriage Act.
